We reserve the right to cancel and/or terminate any user’s account for any violation of these Terms and Conditions or other terms stated on the Pentagon Wines site. Any fraudulent behavior, spamming, flaming, excessive use of profanity or abusive language, either on Pentagon Wines or any other website in regards to Pentagon Wines, or while contacting any of our team, will not be tolerated. By using the Pentagon Wines site, you accept and agree to be bound by these Terms. If you do not agree to these Terms and Conditions or our Privacy Notice, please do not use the Pentagon Wines site.

Pentagon Wines does not sell alcoholic beverages to people under the age of 21. By law, an adult signature (at least 21 years of age) will be required upon delivery of all shipments. By using this site you affirm that you are over the age of 21 and that any alcohol you purchase from this site is intended for personal consumption and not for resale. If you intentionally or unintentionally misrepresent your age in order to provide alcohol to a person under the age of 21, Pentagon Wines reserves the right to initiate legal action against you as well as contact law enforcement officials regarding any illegal actions.

You must contact Pentagon Wines at 469-478-5391 or sales@pentagonwines.com within seventy-two hours of delivery to report broken, corked or otherwise damaged products to request an exchange.

To cancel your Pentagon Wines membership, contact Pentagon Wines in writing by emailing sales@pentagonwines.com.

Pentagon Wines may cancel your membership and refuse any and all current or future use of Pentagon Wines or other services, or any portion thereof: (1) in order to comply with applicable Law.  (2) if you provide any information that Pentagon Wines determines, in its sole discretion, to be untrue, inaccurate, not current or incomplete (or if the information becomes untrue, inaccurate, not current or incomplete). (3) if Pentagon Wines determines, in its sole discretion, that you are using your Pentagon Wines membership in a manner not permitted by these Terms of Service. (4) in other circumstances, as Pentagon Wines deems appropriate in its sole discretion.

While we don’t routinely keep wines we’ve featured in stock, we do occasionally have extra bottles available.  If you love a wine that was part of your order under the “Current Offerings” section of our site, send us an email at sales@pentagonwines.com and we’ll let you know if we have some available. If not, please take a look at, or watch for the upcoming, Current Offerings on our site. If we do have additional bottles, they will be available to customers / members at 50% off the retail price. We may be able to provide you with an additional discount if you email us at sales@pentagonwines.com.

During times of inclement weather, extreme heat, or extreme cold, Pentagon Wines reserves the right to delay pickup until conditions improve. Please be advised that Pentagon Wines is not responsible for items damaged due to extreme weather conditions.

Our model is based upon customers/members picking up their wine at our location. Customers/members will have thirty days from notification of when the wine is ready for the order to be picked up. After thirty days, we will contact you to have your wine shipped to you and you will pay the costs of shipping.

Pentagon Wines reserves the right to disclose your personally identifiable information as required by law and when we believe that disclosure is necessary to protect our rights and/or to comply with a judicial proceeding, court order, or legal process. Pentagon Wines is not responsible and shall not be liable for any injury or damage caused by, or arising from, the consumption of the merchandise sold to its customers.

We may, at any time, revise or modify these Terms Conditions or impose new conditions for use of the Pentagon Wines sites. Such changes shall be effective immediately upon notice to you, which may be given by any means including, without limitation, posting on the Pentagon Wines site. Any use of a Pentagon Wines site or receipt of a Pentagon Wines shipment by you after such notice shall be deemed to constitute acceptance of such changes.

Customers are charged when the customer/member authorizes a charge to their bank account, credit card or another third party payment portal such as Paypal. By clicking the “I understand and I agree” button, you give Pentagon Wines the right to charge the bank account or credit card number you provided for services rendered.

Purchasing wine club products from Pentagon Wines is absolutely safe and secure. In an effort to protect your privacy, Pentagon Wines uses the latest technology to keep your personal information safe. ACH, e-check and credit card transactions are handled by an accredited third-party financial institution, which receives credit card and other personal information for verification purposes and to process transactions.

While we don’t routinely allow cancellation of orders, we will allow a cancellation for a 25% charge. This is because we have designed a process for our members to keep prices as low as possible and this requires customers/members to pre-pay for their wine. These Terms and Conditions and any dispute or claim arising out of or related to these Terms and Conditions, their subject matter or their formation (in each case, including non-contractual disputes or claims) shall be governed by and construed in accordance with the laws of the State of Texas without giving effect to any choice or conflict of law provision or rule. Any legal suit, action or proceeding arising out of or related to these Terms and Conditions or the Pentagon Wines site shall be instituted exclusively in the federal or state courts located in Rockwall, Texas. You agree to waive any and all objections to the exercise of jurisdiction over you by such courts and to venue in such courts.

No waiver of these Terms and Conditions by Pentagon Wines shall be deemed a further or continuing waiver of such term or condition or any other term or condition, and any failure of Pentagon Wines to assert a right or provision under these Terms and Conditions shall not constitute a waiver of such right or provision. If any provision of these Terms and Conditions is held by a court of competent jurisdiction to be invalid, illegal or unenforceable for any reason, such provision shall be eliminated or limited to the minimum extent such that the remaining provisions of these Terms and Conditions will continue in full force and effect.

This contract is fully integrated. Any item not specifically mentioned herein is not a part of the agreement.

Pentagon Wines is the sole owner of the information collected on this site. We will not sell, share, or rent customer information to any other organization. Pentagon Wines’ order forms request data from customers including contact information (such as name, email address, shipping address, and phone number) and financial information (such as bank account number, routing number, credit card number, expiration date, security code, billing address, and billing phone number). This information is used for billing purposes, to verify that the customer is of legal drinking age, and for shipping purposes only. If we encounter difficulty when processing an order, we will use this information to contact the customer. This information is harvested from a secure area and stored safely for our customers’ protection.
